Enforcement of Penalties under Section 25 of the Landlord and Tenant Act 1985:
Morshead Mansions Limited v Di Marco [2014] EWCA Civ 96
The Court of Appeal decided that a Leaseholder does not have the legal right to sue for damages from, or a mandatory injunction against, a Landlord in respect of a breach of either Section 21 or Section 22 of the Landlord and Tenant Act 1985. The law gives the right to bring proceedings (against a Landlord for breach of Section 21 and 22) to Local Authorities and no one else.
